ARTICLE 1: Purpose
These "Terms of Use" (ToU) govern the legal framework for the provision of Escrime-Occasion's services and their use by the "User," whether via the Escrime-Occasion website or mobile application, available on iOS and Android.
These Terms of Use must be accepted by any User wishing to access the website or mobile application before any registration or login. They constitute the contract between Escrime-Occasion and the User. Accessing the website or application by the User signifies their acceptance of these Terms of Use.
Escrime-Occasion reserves the right to unilaterally modify the content of these Terms of Use at any time.
These Terms and Conditions are therefore fully enforceable against Users.
ARTICLE 2: Definitions
This clause defines the essential terms of the contract:
Site: refers to both the website accessible at www.escrime-occasion.com and the Escrime-Occasion mobile application available on iOS and Android, unless the context requires a distinction.
Personal Account: a free space accessible to all Site Users. Once created, it allows Users to post Ads, view published Ads, and view purchases made through the Site.
User Content: refers to the data transmitted by the User within the Site.
Username and Password: the information required to identify a User on the Site. The username and password allow the User to access services reserved for site members. The password is confidential. The User can also log in via a third-party account (Google, Facebook, or Apple), in which case these Terms of Service apply in the same way.
Member: A User becomes a member when they log in to the site.
User: This term refers to any person who visits the site or uses any of the services offered by the site.
ARTICLE 3: Access to Services
The website allows the User to access the following services:
- Free access to classified ads for used fencing equipment
- Free posting of classified ads for used fencing equipment by the user
- Subscriptions to paid offers available on the website to benefit from advantageous features
The website is accessible free of charge from anywhere to any User with internet access, via the website or the Escrime-Occasion mobile application (iOS and Android). All costs incurred by the User to access the services (computer equipment, software, internet connection, etc.) are their responsibility.
Registration and login can be done via email and password, or through a Google, Facebook, or Apple account ("Sign in with Apple"). The User can permanently delete their personal account at any time, directly from the mobile application or their personal space on the website, or by contacting Escrime-Occasion at contact@escrime-occasion.com.
The minimum age for having a personal account on Escrime-Occasion, and for buying and selling equipment, is 13 years old. Minors are the responsibility of their legal guardian.
Professional sellers are not authorized to use the services. They are subject to specific regulations defined by Escrime-Occasion. Access to Escrime-Occasion services may be restricted based on geographical criteria: creating an Escrime-Occasion account and accessing the services is only possible in France (including overseas departments), Belgium, Switzerland, or Luxembourg.
Access to member services is via a username and password. The user is solely responsible for their username and password. They may not use another person's account or allow anyone else to use their account and password. Users are solely responsible for the security of their username and password, as well as for all activity occurring on their member account, whether authorized or not. Each user agrees to immediately inform Escrime-Occasion of any unauthorized use or breach of their member account. In the event of a forgotten password, the user may request to reset it: to do so, they will need the username and email address provided during registration.
The website uses all available means to ensure quality access to its services. As this is an obligation of means, the website does not guarantee this result.
For maintenance or other reasons, access to the website may be interrupted or suspended by the publisher without prior notice or justification. The user agrees not to claim any compensation following the interruption, suspension, or modification of this agreement.
Escrime-Occasion shall not be held liable for any event due to force majeure resulting in a network or server malfunction.

ARTICLE 4: Intellectual Property
All intellectual property rights (including, but not limited to, copyright, related rights, trademark rights, and database producer rights) pertaining to both the structure and content of the Escrime-Occasion website, including but not limited to images, sounds, videos, photographs, logos, trademarks, graphic, textual, and visual elements, tools, software, documents, data, etc. (hereinafter collectively referred to as “Elements”) are the exclusive property of Escrime-Occasion, with the exception of trademarks, logos, or content belonging to other partner companies or authors. Any reproduction, distribution, modification, adaptation, retransmission, or publication, even partial, of these various elements is strictly prohibited without the express written consent of Escrime-Occasion. Such representation or reproduction, by any means whatsoever, constitutes an infringement punishable under Articles L.3335-2 et seq. of the French Intellectual Property Code. Failure to comply with this prohibition constitutes an infringement that may result in civil and criminal penalties for the infringer.
Escrime-Occasion also owns the database producer rights referred to in Book III, Title IV, of the French Intellectual Property Code (Law No. 98-536 of July 1, 1998) relating to copyright and databases.
No hyperlink may be created to the Escrime-Occasion website, nor may any other form of advertising be created without the prior express consent of Escrime-Occasion.
ARTICLE 5: Confidentiality, Personal Data, and Cookies
5.1 The information requested during registration on the website is necessary and mandatory for the creation of the User's account. In particular, the email address may be used by the website for the administration, management, and operation of the service.
5.2 The website ensures that the collection and processing of personal information is carried out in accordance with the French Data Protection Act (Law No. 78-17 of January 6, 1978).
The information collected by the website is recorded in a computer file by Escrime-Occasion for the purpose of enabling the website's operation and is retained for a period of 12 months. The User's personal data is not subject to any commercial transactions or data trading by Escrime-Occasion.
In accordance with Articles 39 and 40 of the French Data Protection Act of January 6, 1978, the User has the right to access, rectify, delete, and object to the processing of their personal data. The User may exercise this right via: the contact form; or by email to contact@escrime-occasion.com.
Escrime-Occasion uses Google Analytics.
5.3 When a User connects with Facebook, Escrime-Occasion receives Facebook account information about that user, which may include their name, gender, email address, current city, and the URL of their profile picture. The User has the right to request the deletion of this data from Escrime-Occasion.
ARTICLE 6: Liability and Force Majeure
Users are solely responsible for the quality of any equipment sold or purchased on the site. The Escrime-Occasion website only facilitates connections between users and is not responsible for the equipment or transactions between users.
The sources of information published on the site are considered reliable. However, the site reserves the right not to guarantee the reliability of these sources. The information provided on the site is for informational purposes only. Despite regular updates, the site cannot be held liable for any changes to administrative and legal provisions that may occur after publication. The same applies to the use and interpretation of the information provided on the platform. Therefore, the user assumes full responsibility for the use of the information and content of this site.
The user must keep their password secret. Any disclosure of the password, in any form whatsoever, is prohibited. The user assumes all risks associated with the use of their username and password. The website disclaims all liability.
The website does not guarantee the complete security and confidentiality of data. However, the website undertakes to implement all necessary measures to ensure this to the best of its ability.
Any use of the service by the User that directly or indirectly results in damages must be compensated to the benefit of the website.
All equipment connected to the Escrime-Occasion website is and remains the sole responsibility of the User. Escrime-Occasion cannot be held liable for any direct or indirect damage that may arise from the User's connection to the Escrime-Occasion website.
The website cannot be held liable in cases of force majeure or for the unforeseeable and insurmountable actions of a third party.
ARTICLE 7: Hyperlinks
The User therefore agrees not to hold the website liable for the content and resources related to these external hyperlinks.
ARTICLE 8: Contract Amendments
The website reserves the right to modify the terms stipulated in this contract at any time.
ARTICLE 9: Duration
This contract is of indefinite duration. The contract takes effect with respect to the User upon their use of the service.
ARTICLE 10: Member Content
The website allows members to post advertisements for used fencing equipment.
In their posts, members agree to comply with the rules of netiquette and applicable laws.
The website moderates posts and reserves the right to refuse to publish them, without having to justify its decision to the member. Escrime-Occasion may make changes to the formatting of advertisements.
However, Escrime-Occasion only operates a matching service and is in no way responsible for transactions between users, nor for the quality of the equipment acquired or transferred.
Members retain full ownership of their intellectual property rights. However, by posting content on the site, they grant the publishing company a non-exclusive, royalty-free right to represent, reproduce, adapt, modify, distribute, and disseminate their content, directly or through an authorized third party, worldwide, in any format (digital or physical), for the duration of the intellectual property rights. Specifically, members grant the right to use their content on the internet and on mobile networks.
The publishing company agrees to display the member's name alongside each use of their content.
Private messages allow members to exchange information about equipment to facilitate transactions. Any other content is not permitted in this space.
ARTICLE 11: Zero Tolerance and Content Moderation
Escrime-Occasion applies a zero-tolerance policy towards offensive, discriminatory, fraudulent, sexually explicit content, or any abusive behavior between Users.
An automatic content filter is applied to messages exchanged via the site's messaging system to detect and censor offensive or inappropriate remarks.
Each User has a way to report an advertisement, a user, or a message that they consider abusive or contrary to these Terms of Service, as well as a way to block another user: blocking immediately prevents any further communication with that user and removes the corresponding conversation from their inbox.
All reports are reviewed by Escrime-Occasion within 24 hours. Depending on the seriousness of the reported incidents, Escrime-Occasion may remove the reported content and suspend or terminate, without notice or compensation, the account of the User responsible for the abusive content or behavior.
ARTICLE 12: Applicable Law and Jurisdiction
If any part of these Terms and Conditions is found to be illegal, invalid, or unenforceable for any reason, that provision will be deemed severed from these Terms and Conditions, without affecting the validity of the remaining provisions, which will continue to apply.
These Terms and Conditions are governed by French law. In the event of a dispute between the parties that cannot be resolved amicably, the French courts shall have exclusive jurisdiction.
